Mediation is one of the alternative dispute resolution (ADR) process in which the parties are assisted by a trained mediator who itself is a neutral third party. Confidential communication, reconciliation and negotiation are facilitated by the mediator between the parties to reach into a voluntary and mutually agreeable resolution which is enforceable in law. Neutrality and confidentiality are assured in mediation.

When the matrimonial relation is irretrievably broken and any party is seeking divorce . When the parties require a solution without waiting for a verdict from a court of law, which are time consuming and not certain. The process of mediation will be apt for who wishes to settle the matter at the earliest and who might be interested in ‘out of court settlement’. Mediation maintains the control over the information received from the parties and ensures its confidentiality. Court files are open to the public , but mediation documents are not.

When a party prefer Court and approach a lawyer , he is required to pay Court fees and lawyers’ fee and they have to keep on paying till the end of litigation. Mediation is less expensive and the mediation charges are to be paid by the parties equally.

What does a Mediator do?
A mediator assists the parties in arriving at an amicable solution through the process of negotiation. He helps the parties in reaching into a mutually acceptable agreement. The parties need not agree to the terms of settlement, if they are not satisfied with the settlement. Judges and arbitrators make decisions that are imposed on parties while a mediator helps the parties to understand the probable outcome of a dispute and then leads the parties to an acceptable settlement.Is mediation settlement legally enforceable? A mediation/conciliation agreement is enforceable as if it is an Arbitration award under the Arbitration and Conciliation Act. It is as good as a decree of a Court of law.
